Unlicensed gun dealer gets 3 years' probation, forfeits 314 weapons, $38K

A Waushara County man has been sentenced to three years of probation for selling guns without a license, but also forfeited more than 300 weapons and $38,432 cash seized when he was arrested back in 2007.

James Schrader, 71, of Wild Rose pleaded guilty in May to one federal count of illegal gun sales from 2005 to 2007. Two other counts were dismissed. The offense carries a maximum penalty of five years in prison and a $250,000 fine. 


Schrader was sentenced Aug. 31 by U.S. District Judge Lynn Adelman, who also required Schrader to perform 10 hours of community service each year he is on probation.

Schrader's grandson, Cody Sustman, stole guns from his grandfather and sold 30 of them to felons in Milwaukee. He sold the gun used in the 2006 murder of Joseph Munz, a Jimmy John's delivery driver.
Sustman was convicted of selling guns without a license and sentence to nearly three years in prison. 


According to court records, Schrader once had a license to sell guns but it expired in 1991. He kept selling at 10 to 12 gun shows a year, averaging about $1,500 profit at each one. In late 2006 and early 2007, Schrader sold handguns to undercover agents at shows in Green Bay and Fond du Lac without requiring any paperwork.

Schrader was the third man this year sentenced for illegal gun sales after prosecution by the U.S. Attorney's office in Milwaukee.

A 75-year-old Hartford man who sold more than 100 firearms at gun shows. Raymond L. Anderson touted "no paperwork, no taxes, no waiting period" to undercover agents.

Gerald Golke, 74, of Pewaukee was sentenced to a month in prison and three years' probation for knowingly selling firearms to a Milwaukee man he knew was a felon.

Federal law defines a dealer as someone who makes a significant amount of their income from gun sales. Such people are required to have a license and do background checks on gun sales.

However, individuals who occasionally sell firearms, at gun shows or elsewhere, do not need a license or to go through background checks.
