Yes, if the ITC issues a LEO, Nok can seek to have it overturned via Mr. Kirk, a cabinet member on the Obama team. This takes 60 days. The next step after that is a revisit with the CAFC. The difference this trip is that the LEO stays in force during the time it takes the CAFC to conduct the appeal. This should act as a real eye opener on Pennsylvania Ave regarding the devastation a foreign bully can cause on a small company of American inventors by willfully placing infringing products in commerce. Quite a contrast to the lobbying BS they have heard from the big OEM's during the patent reform push.
