IMO, Luckern did not go to the doctor on a Friday and retire on a Monday, but I could be wrong. I was thinking that some had known for a week or 2. I also think that 2 long time judges (Newman and Luckern) might even be friends or atleast hear through the grapevine what is going on. In any case, it does not really matter as I could be correct about the timing this week but wrong on my theory.

His retirement was not planned. It was sudden. In fact, if the CAFC knew he was retiring, they would have reversed quickly in order for him to review his notes and prepare a new initial final determination. A newly assigned judge will have a lot on his/her plate wading through the record. The staff attorney is no longer with the ITC. I hope they do not give Nok another evidentiary hearing causing further delay due to both the judge and staff attorney absences.
