WASHINGTON — In a decision that could rewrite the game book for working women across the country, the U.S. Supreme Court on Monday ruled for Wal-Mart in the largest sex-discrimination lawsuit ever.

that gave the lawsuit class-action status.
The justices overturned an earlier U.S. appeals court ruling that gave class-action status to 1.5 million female Wal-Mart employees, past and present, seeking billions of dollars in a suit accusing Wal-Mart of paying women less and giving them fewer promotions at the company.
The court cited two reasons for its decision. It was unanimous in saying that the women brought the wrong kind of class action, improperly mixing questions that can be decided in a class action, such as whether to order the company to stop discrimination, with issues that must be decided for each individual, such as how much back pay to award.
The court ruled 5-4 that the women failed to show that there's some glue to hold all these cases together, a demonstration that there's a common source of each case of discrimination.
In fact, the court said, the evidence seems to point in the opposite direction, that Walmart had a corporate directive against discrimination and left decisions about pay and promotion policies to each individual store manager. The court's ruling on this second point will make it very difficult for the women to regroup and try to file another class action lawsuit against the retailer.
“Without some glue holding together the alleged reasons for those decisions, it will be impossible to say that examination of all the class members’ claims will produce a common answer to the crucial discrimination question,” the court said in its official decision.
