10-1358-cv Nokia Corporation v. InterDigital, Inc., et al. 05-23-2011 OPN

VACATED and REMANDED

Appeal from an order of the United States District Court for the Southern District of New
27 York (Batts, J.), denying Defendants-Appellants’ motion to recover against a preliminary
28 injunction bond posted pursuant to Fed. R. Civ. P. 65(c). We hold that a wrongfully enjoined
29 party is entitled to a presumption in favor of recovery against an injunction bond. We also
30 conclude that the district court’s decision was insufficient to permit meaningful appellate review.
