­China's Huawei has launched a spate of lawsuits against its local rival, ZTE over alleged patent and trade mark infringement. The lawsuits have been filed in Germany, France, and Hungary were filed on the basis that ZTE is infringing a series of Huawei's patents relating to data card and LTE technologies.

Huawei is also alleging that ZTE used a Huawei-registered trademark on some of its data card products.

Huawei's Chief Legal Officer, Dr. Song Liuping said the lawsuits were commenced after ZTE failed to respond to cease and desist letters requiring the company to stop carrying out the infringing acts that are the basis for these proceedings.

Huawei had also actively invited ZTE on numerous occasions to enter into cross-patent licensing negotiations but was apparently equally unsuccessful.

"Intellectual property is among Huawei's most valuable assets. That is why we feel a responsibility to our customers and to our shareholders to do everything possible to protect these assets in any legal jurisdiction worldwide. Where violations are taking place, we will do whatever is required to ensure that the use of Huawei's intellectual property by any company is based on internationally accepted protocols and practices," Dr. Song said.

In a statement, ZTE said that it "is astonished that Huawei Technologies has taken these legal actions". As a company listed on the Hong Kong stock exchange, ZTE respects and adheres to international intellectual property laws and regulations without reservation, and absolutely rejects that there has been any patent and trademark infringement.

1:40 PM -- Huawei Technologies Co. Ltd. managed to take the current round of patent lawsuits to a new level Thursday by filing lawsuits against its Chinese rival and neighbor ZTE Corp. (Shenzhen: 000063; Hong Kong: 0763)

The actions, taken through a number of separate European courts, relate to Long Term Evolution (LTE) and data card patents as well as the allegedly illegal use of a Huawei trademark.

An "astonished" ZTE, already on the sharp end of recent legal suit issued by Ericsson AB (Nasdaq: ERIC), rejected Huawei's claims, saying it would defend itself vigorously. (See Huawei Sets Lawyers on ZTE, ZTE Denies Huawei Patent Theft Allegations and Ericsson Sues ZTE Over IPR Theft.)

No doubt there will be those in the industry who will enjoy a touch of schadenfreude (laced with a sprinkle of irony) at the news that the two largest Chinese vendors are now embroiled in a dispute concerning the alleged illegal use of patented technology, given the accusations that have been leveled at the Chinese vendor community in the past. (See MWC 2011: NSN Chases 'Spy' off Stand.)

The main concern, though, is that, given the growing number of intellectual property lawsuits being issued currently, the industry may get embroiled in a spiraling volume of legal actions that could drain resources and impact R&D.

I mean, just check out the recent legal mudslinging!! When will it end?
