I do not disagree that civil and criminal penalties for not following agency regulations should be set by Congress, BUT I do believe forcing all of the agencies to publicize these things for all to see, as an initial step, is a very good thing - because it subjects all of this to daylight, which hopefully (I won't hold my breath, but one can always hope!) will spur Congress to act on the most egregious of this regulatory nonsense.
