You’re are correct. It was the helicopter pilots fault.

The helicopter pilot failed to follow the controller’s direction when told to pass behind the jet.

The helicopter pilot flew above the restricted altitude and into restricted airspace that belonged to the landing plane.

The helicopter pilot requested permission to fly Route 1 and Route 4 which are FAA designed and approved paths through the airport’s controlled airspace. The controller gave the helicopter permission. The helicopter pilot failed to comply with the rules and restrictions required to use route 4. (Failed to maintain proper altitude)

Well,ain’t no man gonna mansplain to her again.
