On the brewhaha about illegal deportations
1. SCOTUS correctly ruled that the Admin CAN deport illegals under the law that is on the books about 'enemy aliens.'
I do have a major problems with other things that have been done.
First the givens that will be accepted as FACTS.
1. The administration contends that those sent to El Salvadora were sent with incontrovertible evidence that they were gang members, including TrenDA and MS13. Although their 'proof' has not been presented and TESTED UNDER CROSS EXAMINATION in any Criminal Court, I will accept their assertions as being true.
2. The Executive branch has indisputable legal and Constitutional authority to export illegal aliens, period. This both in US Federal Law and the Constitution.
3.These illegals may be LEGALLY DETAINED in jail, awaiting deportation.
4. These illegals DO NOT HAVE the full range of rights that U.S. Citizens have under the Constitution.
5. These illegals CAN be extradicted to foreign countries, legally, upon extreadiction requests from said countries (with whom we have treaties), with said orders being subject to U.S. Executive branch (including State Department, DOJ, etc.) review/approval AND JUDICIAL REVIEW, WITH DEFENDANT LEGAL REPRESENTATION, in accordance with U.S. LAW.
No problem ... so far.
Where this cantankerous curmudgeon has a problem is with IMPRISONMENT, whether domestically or foreign contracted under U.S. control without a trial in UNITED STATES COURTS, either federal or state.[/b]
That, sirs, is one RIGHT that ALL citizens, immigrants, and even illegal immigrants DO have in the UNITED STATES.
Yes, our criminal justice system is broken - BUT broken or not, NO ONE IN OUR GOVERNMENT may just ignore it, nor bypass it. PERIOD
So, the imprisonment of that gang member BY THE UNITED STATES by using a 'foreign prison' for a known gang member, deported by 'clerical' mistake (against a court order) and imprisoned WITHOUT TRIAL NOR CONVICTION, CAN NOT STAND. This is a SCOTUS CASE that will definitely go AGAINST the DOJ and Trump Administration.
Even Russia and China do not attempt to openly throw their justice systems out the window to imprison people, YES - they do use a farcical system to do so, kangaroo courts and judges, with no real legal defense afforded to individuals - and WE RIGHTFULLY DENOUNCE SUCH ACTIONS when they occur.
We must hold ourselves to higher standards.
Finally, brethren, whatsoever things are true, whatsoever things are honest, whatsoever things are just, whatsoever things are pure, whatsoever things are lovely, whatsoever things are of good ...
