I was thinking summary judgement the other way around, with damages being the only thing left to discuss.

But maybe Dominion wants this to go to trial now, as they will win and they may want to expose Fox's repellant way of operating more broadly and to have the courts impose restrictions on its future behaviour.

In Fox's situation, I'd be desperate to settle.

From what I've read, Murdoch is an unfit owner of a newspaper. He pretends that what he serves is news, knowing full well it's made up. So I don't think his organisation should be permitted the protections given to news organisations, which Murdoch hides behind. They should be exposed to any number of future lawsuits to get them to change the way they operate.

BREAKING: In loss for Fox News, judge sends Dominion defamation case to trial
A judge denied Fox News’ request for summary judgment in its attempt to get Dominion Voting Systems’ $1.6 billion defamation lawsuit thrown out, meaning the case will go to trial in mid-April.

Delaware Superior Court Judge Eric Davis also handed Dominion a major win when he agreed that it is “CRYSTAL clear� that none of the statements aired on Fox News about Dominion’s role in the 2020 election were true.
