I am not sure why SCOTUS would even take this case. They are way too deep into politics. This kind of decision surely belongs to the government, as it did when Trump signed the law.

They are out of control.

BREAKING: Supreme Court delays end of Title 42, keeps in place a Trump-era immigration policy allowing asylum-seekers to be quickly turned away at the border
Supreme Court Chief Justice John Roberts on Monday issued a temporary stay that will delay the end of a Trump-era immigration policy implemented during the pandemic to allow asylum-seekers to be quickly turned away at the border. The rule was set to expire on Wednesday.

The stay request came from 19 states, led by Arizona and Louisiana, after a lower court last week rejected their request to intervene in a bid to block an order that the policy, known as Title 42, be wound down.
