I think the court will be sceptical of Musk's excuses for not purchasing the company.
He made an offer. There was a contract. He wants to walk away. He has made an excuse. But he has already done damage. And he appears not to be a man of his word.
He would have made twitter worse with his ideallistic model of how it shoud work. Anyone who posts anywhere knows how terrible the free-for-all approach is. There can be no polite conversation when some people seek to make it unpleasant. All you end up with is insults and shouting. So the rules of the game in social media are designed to approximate the sorts of etiquette which make friendly chatting possible. Unforunately, exclusion is a necessary tool.
