Good decision.

Even if they don't need the mandate today, they may need it next week and have to get rid of the precedent the judgement sets.

Governments need to be able to combat pandemics as best as they can so long as they don't go crazy. It's simple. You combat viruses by medical means, not by exercising rights that aren't fit for purpose.

The Justice Dept. will appeal a court ruling striking down the federal mask mandate on public transportation, at the C.D.C.’s request.
Wednesday, April 20, 2022 6:32 PM EST

The Centers for Disease Control and Prevention said it had concluded that “an order requiring masking in the indoor transportation corridor remains necessary for the public health.”

The announcement came a day after the Biden administration said it intended to appeal the ruling from a Florida judge — but only if the C.D.C. decided that the mask mandate was still necessary.
