Next thing you know, they'll be asking this judge to overturn the no-smoking rules on planes. If the judge can claim that the mask mandate is "unlawful" she could just as easily rule that the smoke-free mandate is "unlawful".

Federal judge in Florida strikes down CDC mask mandate for planes, trains and other public transit
A federal judge on Monday struck down the Centers for Disease Control and Prevention’s rule that all travelers must wear masks on airplanes, buses, trains and other modes of public transportation, calling it “unlawful.”

The ruling, from U.S. District Court Judge Kathryn Kimball Mizelle in Tampa, said the CDC had overstepped its legal authority by imposing the mandate in February 2021.
