I know. But there's a motive of hatred of some kind for every murder (pain exception). What you do by making a special category is to suggest non-conforming murders somehow lack the same quality.
For me, the murderous action and the murderous state of mind is what counts. I don't feel it serves a purpose to say, he committed the crime because the victim was black, any more than he committed the crime because it was thursday. Convicting a person of murder has the hatred baked in. Without the hatred and the intent, it is manslaughter.
It's a tautology.
