Court docs: NY man assaulted DC officer during Jan. 6 riots, buried badge in backyard

WASHINGTON (WJLA) — A New York man charged in the U.S. Capitol riots assaulted a Metropolitan Police Department officer and then buried the officer's badge in his backyard, according to the U.S. Department of Justice.
Thomas Sibick, of Buffalo, faces multiple charges related to the January 6 riots, including:
Knowingly Entering or Remaining in any Restricted Building or Grounds Without Lawful Authority;
Violent Entry and Disorderly Conduct on Capitol Grounds;
Obstruction of Law Enforcement During Civil Disorder;
Assaulting, Resisting, or Impeding Certain Officers; and
Taking from a Person Anything of Value by Force and Violence or by Intimidation Within Special Maritime and Territorial Jurisdiction.
According to a federal complaint, investigators first learned of Sibick after two witnesses came forward in late January. The first witness told federal authorities Sibick posted to his Instagram story while at the Capitol riot. In the video, Sibick yelled, "Just got tear-gassed, but we’re going, baby, we’re going! We’re pushing forward now!”
The second witness told authorities they saw Sibick post pictures from the riots on Facebook.
When authorities interviewed Sibick on January 27, he tried to explain he was assisting an officer during the chaos, according to the complaint. That officer was Officer Michael Fanone with DC Police. Sibick told federal agents he was trying to intervene and pull Officer Fanone out of the crowd but couldn't. When asked about a photo of him with a law enforcement riot shield, the Buffalo man said he took a photo with it.
Officer Fanone is one of three officers that spoke to ABC7 in the wake of the riots, saying he was pulled into the crowd and immediately targeted by rioters. Federal authorities said people yanked off his items, including his police badge, #3603.
One person, going after his service weapon, yelled that they were going to "kill him with his own gun." According to the court documents, Sibick heard that statement as well. Fanone was treated that night for having a heart attack.
Agents interviewed Sibick about a month later on February 23, this time with images from Officer Fanone's body cam. When asked about the officer's badge and radio, Sibick first said he dropped the items; however, he then told authorities he threw them away at his hotel.
That also proved to be untrue; when confronted with a fake email about agents searching the hotel cameras for evidence, the complaint stated Sibick called the agent up and told them the truth: he threw the radio away, but the badge was buried in his backyard.
According to the complaint, Sibick turned over badge #3603 on February 26.
