The George W Bush appointed federal judge just ruled that the plaintiff's did not have standing and threw-out their case:

And they've already filed suit in federal court. The judge will hear their arguments on Monday morning and depending on what he does, these two Republican state legislators have implied that they may have to file an emergency petition with the US Supreme Court in an attempt to force them to take-up their case if the tomorrow's federal judge refuses to do anything.
