On Monday night the American Civil Liberties Union and a law firm, Perry Guha LLP, filed suit against the DOJ for what they called the "unconstitutional incarceration of Michael Cohen in retaliation for his plans to publish a book critical of the president shortly before the November election."
According to the ACLU, "the lawsuit argues that Cohen's detention in retaliation for his protected speech violates the First Amendment, and that he be immediately released."
>> Via email, Ben Wizner, director of the ACLU's Speech, Privacy, and Technology Project, told me "the government cannot imprison Michael Cohen for writing a book about President Trump. The gag order that the government sought to impose on Mr. Cohen was an unconstitutional prior restraint, and his continued imprisonment is part of a dangerous pattern of retaliation against Trump critics."
