Twin Son of Gay Couple Granted Citizenship After Legal Fight
A federal judge in California has ruled that the twin son of a gay married couple has been a U.S. citizen since birth—a defeat for the Trump administration, which had only granted the status to his twin brother.
District Judge John F. Walter found the State Department was wrong to deny citizenship to 2-year-old Ethan Dvash-Banks because U.S. law doesn’t require a child to have a biological relationship with their parents if they were married at the time of the child’s birth.
The twins were conceived with donor eggs and the sperm from each father—one an American, the other an Israeli citizen—but born by the same surrogate mother minutes apart.
DNA tests showed that one twin, Aidan, was the biological son of U.S. citizen Andrew Dvash-Banks, while Ethan was conceived from the sperm of Israeli Elad Dvash-Banks.
“This is justice! We are hopeful that no other family will ever have to go through this again. It’s like a giant rock has been removed from our hearts,” Andrew and Elad Dvash-Banks said in a statement.
