Matt Whitaker's appointment as acting attorney general faces new challenge, this time in the Supreme Court

Opponents of Matt Whitaker's appointment as acting attorney general opened a new legal front Friday in the fight over his selection, asking the U.S. Supreme Court to rule that he is not legally qualified for the job because he was not confirmed by the Senate.

The latest challenge came in a lawsuit pending before the court that was filed in June, when Jeff Sessions was the attorney general. The challengers on Friday asked the justices to rule that the name on the case should now be Rod Rosenstein, who they said is actually the acting attorney general.It’s the second court challenge to President Donald Trump’s decision to appoint Whitaker as acting attorney general, and his administration has defended Whitaker’s selection as entirely legal.
