If it's determined that Jefferson Beauregard Sessions III was fired and did NOT voluntarily resign, Trump would be in violation of the 'Federal Vacancies Reform Act of 1998' which requires that Senate approved positions can ONLY be filled by someone who has previously been confirmed by the Senate or who's name is first submitted to the Senate for review and eventual confirmation. It would appear that Matthew Whitaker does NOT meet either of these criteria.
