Judge Rejects Texas’ Request to End DACA

A Texas federal judge on Friday denied the state’s request to end Deferred Action for Childhood Arrivals (DACA), saying the state waited too long to file suit and that ending the program could be harmful.

The judge, however, did predict that DACA would eventually end, saying the program is likely illegal. “DACA is a popular program and one that Congress should consider saving,” District Judge Andrew Hanen wrote in the ruling. Nevertheless, “this court will not succumb to the temptation to set aside legal principles and to substitute its judgment in lieu of legislative action.

If the nation truly wants to have a DACA program, it is up to Congress to say so,” he wrote.
