...there was a story in the news awhile back about a cop shooting at a snake or something on the ground and killing a kid who was fishing down by a local lake with his grandpa. IMHO, it's your bullet til it stops and ya don't have a RIGHT to spray the whole community with bullets just cause you ain't comfy.

Oh, I would be SHOCKED if this former police officer were to be given the death penalty - THAT would be highly inappropriate in this case. You are quite correct ... his actions were absurdly reckless, but it absolutely was NOT premeditated murder.
