He can't just deep-six this unconstitutional, rogue agency because the Democrats created this extra-constitutional bureaucracy and supposedly placed it outside the pervue of Congress. So, the way to get rid of it is to have Congress kill it or to litigate its unconstitutionality before the Supreme Court.
