...advertising is free speech, but calling me and waking me up to sell me something isn't covered in the first amendment. If ya look at your life you will see that about twenty minutes of every hour is spent looking at what is basically SPAM. Whether it's ya computer or ya television or if ya are driving down the road unable to see the scenery for the advertising, it's SPAM. Does free speech give someone the right to spend most of their day screaming in your ear about some product or another?
