It probably is illegal without permission.

But I am not sure if it can be withheld as evidence once the cat is out of the bag. What is known is also incapable of becoming unknown, so from the viewpoint of the public conversation, we know there's a tape and what was talked about. And Cohen can provide any details of the conversation and it will be hard for Trump to deny them.

Michael Avenatti was dining in NYC last week & Michael Cohen was 6 feet from him, they spoke.
Avenatti said yesterday on Ari Melber's show he wouldn't rule out representing him, if Cohen came clean & Stormy gave him a waiver.
That would send Trump over the edge! hahaha

President Donald Trump tweeted on Saturday that it is "inconceivable that a lawyer would tape a client — totally unheard of & perhaps illegal." The comment came after reports that Michael Cohen, his former personal attorney, secretly recorded Trump shortly before the 2016 presidential election discussing buying the rights to the story of a former Playboy model who alleges she had an affair with the president.

“The good news is that your favorite President did nothing wrong!” Trump added.
